Dave Hardy is a superb attorney, outstanding scholar, great filmmaker, etc. etc. He has a couple of new posts worth reading.
First, he notes two papers on "standards of review," and how they may apply to DC v. Heller. One is by law prof Glenn Reynolds (high standard) and another by law prof Adam Winkler (low standard).
Second, he has some info on the infamous Oklahoma hood named "Miller" of U.S. v. Miller fame, which the gun grabbing crowd points to as proof that the 2A applies to militias only, not individuals. Of course, they leave out the pertinent fact that Mr. Miller never showed up for arguments before the high court in 1932, so the Court only heard the government's argument. In the absence of any opposing viewpoint, the Court automatically found in favor of the government.
Dave has information on the Miller case, including the observation that the District of Columbia -- today -- is making virtually the same argument in its appeal of Heller/Parker that the U.S. government made against Mr. Miller some 85 years ago.
